It depends on your state and, more often, on your utility — and you should settle it before you spend anything. Utah legalized plug-in solar explicitly in 2025. Elsewhere the answer ranges from “no requirement at all” to a full interconnection application designed for rooftop systems. The device is small; the paperwork was not written with it in mind.

Three separate approvals, not one

People ask whether plug-in solar “needs a permit” as though there is a single gate. There are three, and they are administered by different bodies with different concerns.

The utility is the one that matters most, and the one people forget. A building department may have no opinion about a device you plug into an existing outlet. The utility has a strong opinion about anything that pushes current onto their distribution network, however small.

What Utah changed

In 2025 Utah became the first US state to pass legislation explicitly permitting plug-in solar. The law establishes that a plug-in system within a defined output limit does not require the full utility interconnection process that a rooftop array does, provided the equipment meets recognized safety standards.

The significance is less about Utah than about the precedent. Until then, plug-in solar in the US existed in a grey zone: not clearly illegal, not clearly permitted, and dependent entirely on whether a particular utility chose to notice. A state saying plainly that a certified device under a stated wattage may be plugged in gives manufacturers a market to sell into and other legislatures a template to copy.

Several other states have since examined similar measures. This is a fast-moving area, and any article you read on it — including this one — may be out of date. Check your own state’s current position rather than relying on a summary.

Do not assume Utah’s rules apply to you. Utility interconnection rules are state and utility specific. A kit that is unambiguously fine in Salt Lake City may require an application in the next state over, and the retailer selling it to you is generally under no obligation to tell you that.

Why the US is behind Europe on this

Germany has well over a million balcony solar installations, a legal right for tenants and condo owners to install one, an 800W inverter limit, and a simplified registration process. The technology is identical to what is sold in the US. The difference is entirely regulatory, and understanding why helps you have a more productive conversation with your utility.

Three obstacles, none of them about the device being unsafe:

  • Backfeed rules in the National Electrical Code. The code governs how much power may be fed into a branch circuit from the load side, and its provisions were written with larger fixed systems in mind. A plug-in inverter is an awkward fit for rules that assume a hardwired connection at the panel.
  • Equipment certification. US practice expects grid-interactive inverters to be listed to UL 1741. Many European kits are certified to European standards instead, so they cannot simply be imported and sold here.
  • Interconnection processes built for rooftop. Applications ask for site plans, single-line diagrams and licensed installer sign-off. None of that has a sensible answer for a panel hanging from a balcony railing, so applicants get stuck rather than refused.

The practical effect is that the friction is procedural rather than substantive, which is precisely the kind of problem legislation like Utah’s is designed to remove.

The questions to ask your utility

Call, and put the same questions in writing afterwards so you have a record. Be specific, because a vague question about “solar” will be routed to the rooftop team and answered as though you are installing 8kW.

  1. “Do you permit plug-in or balcony solar systems under [X] watts that connect through a standard outlet?” State the wattage. It changes the answer.
  2. “Does a system this size require an interconnection agreement?”
  3. “If so, is there a simplified process for small systems?” Many utilities have a fast-track tier that staff do not volunteer.
  4. “What inverter certification do you require?” Expect UL 1741 or UL 1741-SB.
  5. “How does my meter handle exported energy?” This decides whether surplus is credited, ignored, or — in the worst configuration — billed to you as though consumed.
  6. “Is there a fee?”

Tone matters more than it should. Utilities are used to fielding calls from people trying to avoid rules; a straightforward “I want to do this correctly, what is the process” gets a materially better response, and often reaches someone who has dealt with the question before.

Ask about the meter even if everything else is permitted. Some digital meters record energy flowing in either direction as consumption. On such a meter, exporting surplus would increase your bill rather than reduce it — which turns a sensible purchase into an expensive one, and is a strong argument for sizing the kit to your baseline load.

Renters, landlords and HOAs

If you rent, the utility question is only half of it. You also need your landlord’s agreement, and the way you ask changes the answer.

What tends to work:

  • Emphasize that nothing is permanent. No drilling, no roof work, no electrical modification. Clamp-on railing brackets and a plug.
  • Offer to remove it at the end of the tenancy and restore the space, in writing.
  • Address the two things landlords actually worry about: damage to the building and something falling off it. Show them the mounting hardware and its wind rating.
  • Get the agreement in writing, even informally by email. Verbal permission does not survive a change of property manager.
  • Check your lease for clauses on alterations, balcony use and items visible from outside.

For condo owners, HOA rules are the equivalent hurdle. Many states have solar access laws that limit an HOA’s ability to prohibit solar installations, though these were generally written with rooftop systems in mind and their application to balcony kits is not always clear. Equipment certification

Whatever your jurisdiction decides, buy equipment that can survive the question.

  • UL 1741 listed microinverter. The US safety standard for grid-interactive inverters. UL 1741-SB is the newer supplement covering grid-support functions. This is the first thing anyone official will ask about.
  • Anti-islanding protection, included in that standard. The inverter shuts down within seconds if grid power disappears, so it cannot energize a line a utility worker is repairing.
  • Panels certified to UL 61730 or IEC 61730.
  • Documentation you can actually produce if asked. Keep the certificates.

Uncertified imported kits are cheaper and are the ones that create problems — with your utility, with your insurer, and in the rare case of a fire, with the question of who is liable. The saving is not worth it.

What actually happens if you skip this

Realistically, most small plug-in systems are never noticed. That is not the same as it being a good idea, and the failure modes are worth knowing:

  • Your utility discovers it — through a meter anomaly or an unrelated visit — and requires removal or retrospective interconnection. Inconvenient rather than catastrophic.
  • Your meter counts export as consumption, and you quietly pay more each month while believing you are saving. This is the most common real harm, and it is entirely avoidable by asking one question.
  • An insurance claim is complicated by uncertified equipment attached to the building. Unlikely, but expensive if it happens.
  • Your landlord objects after installation and you lose both the deposit argument and the panels’ position.

None of this argues against plug-in solar. It argues for spending an hour on the phone before spending several hundred dollars on hardware.

A checklist before you buy

  1. Check whether your state has passed plug-in solar legislation.
  2. Call your utility with the six questions above, and follow up in writing.
  3. Ask how your specific meter treats exported energy.
  4. If you rent, get written landlord permission. If you are in a condo, check HOA rules and your state solar access law.
  5. Ask your city or county whether an electrical permit applies to a plug-connected device.
  6. Buy only UL 1741 listed equipment and keep the paperwork.
  7. Size the kit to your baseline load, so little or nothing is exported.
  8. Check the structural attachment and wind loading of your mounting.
